Form 8849 is used to claim a credit on vehicles that you had paid HVUT for during the previous tax year. The credit amount of your HVUT can be claimed only under certain conditions. You must report the respective vehicles in the following sections while filing your Form 8849:
Sold/Destroyed/Stolen Vehicles - If you filed Form 2290 and paid the HVUT for a particular vehicle, and if the vehicle was sold, destroyed, or stolen during the tax year, you can claim a refund on the HVUT paid for that vehicle.
Low Mileage Credit Vehicles - If you have filed Form 2290 and paid the HVUT for a vehicle, and the vehicle does not cross 5000 miles during the tax year, you can claim a refund on the HVUT paid for that vehicle.
Tax Overpayment - If you made a mistake while filing your Form 2290 return and paid an excessive amount as your HVUT, you can claim that amount as a refund by filing Form 8849. Some of the common errors made are:
1. Choosing the wrong weight category and paying an excessive HVUT amount.
2. Filing your Form 2290 and paying the HVUT for your vehicle with the wrong tax year or first used month.
3. Filing your Form 2290 and paying the HVUT for your vehicle with the wrong Employer Identification Number (EIN).
